Introduction

These Terms and Conditions apply to the use of the BorisDoes marketplace platform at www.borisdoes.com.au and related subsidiary services.

Definitions

For the purposes of these Terms and Conditions, the following definitions will apply:

  • “BorisDoes” is the marketplace platform at www.borisdoes.com.au, the quoting and invoicing system used on that platform, and all directors, employees and other authorised representatives of BorisDoes.
  • “Customer” is an individual or commercial end user seeking or procuring services on the BorisDoes platform.
  • “Service Provider” is an individual or commercial entity (which may or may not have an ABN) seeking to provide services to Customers or advertising their services on the BorisDoes platform. BorisDoes variously refers to these Service Providers as Taskers (individuals) or Businesses (companies) but may refer to them in alternate terms.
  • “Task” is a specific task, job or service being provided by a Service Provider, or being requested of a Service Provider, or for which a quote has been provided by a Service Provider, or for which a request has been posted on the BorisDoes platform by a Customer.
  • “Users” are those individuals or businesses who have registered on the BorisDoes platform and may include Customers or Service Providers as defined above.

User Agreement

By registering as a Customer or Service Provider on the BorisDoes platform, users are considered to have accepted these Terms and Conditions. These Terms and Conditions apply to all interactions and transactions between Customer or Service Provider on the BorisDoes platform and all interactions and transactions between Customer or Service Provider and representatives of BorisDoes.

Task Allocation and Acceptance

Published tasks can be allocated to a Service Provider upon acceptance of a quote. The allocated task is then presented to the Service Provider for acceptance.

When a task is allocated to - and accepted by - a Service Provider (on the basis of a quote) it becomes no longer visible to other Customers and Service Providers.

Only the Customer who posted the task and the Service Provider to whom a task has been allocated can see an allocated and accepted task.

Quotes, Invoices and Payments

Terms and Conditions associated with the BorisDoes quoting and invoicing system utilised by the BorisDoes platform are outlined in the Terms and Conditions associated with that system and must be separately accepted by Customers and Service Providers prior to use.

Task Completion

Once a task has been allocated and accepted, the Service Provider that accepted it is responsible for completing the task in the timeframe specified in their quote or in the originally published task request (whichever is sooner).

Disputes

Where possible, the BorisDoes Support Team will mediate a resolution in cases of dispute or disagreement, but will always encourage a Customer and their Service Provider to establish a compromise outcome that satisfies all parties.

BorisDoes is not ultimately responsible for mediating disputes and all services provided by a Service Provider to a Customer are subject to the consumer protection regulations and legislation of the jurisdiction in which the Customer is located. Where a task includes services to be provided online or remotely, any contractual obligation established between users is considered to have been established in the jurisdiction in which the Customer is located.

Prohibited Activities

The following transactions and material are prohibited on BorisDoes by law, company policy, or both:

  • Material that is of a sexual nature. This includes advertising for adult services or content that is explicit, pornographic, or intended for mature audiences.
  • Material that depicts violence or makes threats of violence. This includes material that advertises or offers access to violent or graphic content or activities.
  • Financial services or financial advice, other than those services or advice offered by qualified and registered financial advisors and accountants.
  • Legal services and advice, other than those services or advice offered by qualified and registered lawyers and solicitors.
  • Offers of trades services from Service Providers not qualified to perform those trades services including - but not limited to - electrical, plumbing, engineering, and construction services.
  • Services that include the sale or distribution of alcohol, other than those services offered by Service Providers that are appropriately licensed to do so in their jurisdiction.
  • Material or services specifically prohibited by law including - but not limited to - narcotics, gambling or gaming content, or stolen goods.

BorisDoes reserves the right to delete task listings, posts, profile content, and other published material without notification. BorisDoes reserves the right to refer any suspected breach of law to law enforcement agencies along with identifying data associated with the account responsible for publishing the material.

Intellectual Property

BorisDoes is the owner of all intellectual property associated with the BorisDoes platform, including material published on the BorisDoes platform by users. Users shall make no claim of ownership with regard to intellectual property associated with the BorisDoes platform.

Privacy and Data Protection

BorisDoes collects a range of user data in accordance with Australian data security, privacy and confidentiality law.

BorisDoes has access to all communications data for communications conducted using the BorisDoes platform, including the text of chat discussions between users, photos, documents, and digital signatures.

Any user who submits, uploads, stores, shares, or otherwise processes documents, information, or data on the BorisDoes platform or as part of transactions associated with the BorisDoes platform consents to BorisDoes access and processing of that data in accordance with our Privacy Policy, these Terms and Conditions, and the Terms and Conditions associated with the BorisDoes quoting and invoicing system.

BorisDoes reserves the right to remove or delete data from the BorisDoes platform and will do so in accordance with applicable law.
